How Using Social Media Can Hurt Your Criminal Case

How Using Social Media Can Hurt Your Criminal Case

Posted on March 5, 2020 by Accel Admin

In today’s day and age, people are constantly on their phones tweeting, taking pictures, and texting. Unfortunately, if you have recently been charged with a crime, there is a very good chance your cell phone, and particularly your social media activity will come under scrutiny. If you are someone who is currently facing criminal charges, you must read on and reach out to our experienced Texas criminal defense attorneys to learn more about how social media can affect your claim and how we can help you fight your charges. Here are some of the questions you may have:

Can my social media posts be used against me in court?

In short, the answer is yes. In most cases, your posts on social media can, and will, be used against you. That is why it is always a good rule of thumb to not post anything you wouldn’t want a judge to see. Posts of you doing things such as drinking alcohol, using drugs, or trash-talking someone can all drastically impact the outcome of your case. In fact, even text messages can be used against you, especially if they are threatening in nature. Though we understand people get into arguments without ever getting violent, if someone is accusing you of assault and have threatening texts sent from your phone, you can bet it will be used as evidence.

Can courts use my posts if my social media account is private?

Unfortunately, this makes very little difference. Though we’d like to think that having a private social media account actually offers us privacy, this is simply not the case. Essentially everything you’ve ever posted can be obtained, which is why you should always be on your best behavior when posting or even refrain from posting entirely–especially while your case is still ongoing.

Can deleting social media posts hurt my criminal case?

In many cases, the answer is also yes. Once you post something, it’s out there forever, even if you do delete it. What’s more, if you are caught deleting certain posts, it can be interpreted as an admission of guilt–or at least underhanded, which never works in your favor. If you are facing serious criminal charges, you know where to turn. Carrol & Hinojosa will fight for your rights, every step of the way.
