Please continue reading and reach out to our knowledgeable Texas Criminal defense attorneys to learn more about how we can help you through every step of the process ahead. We are here to fight for you and your family. Here are some of the questions you may have:

What are the penalties for child endangerment or abandonment charges in Texas?

There are various potential penalties for child endangerment, though their repercussions depend largely on the circumstances of your charges. Some of those penalties are as follows:

  • If you intentionally abandon a child of whom you have custody or control over and he or she is under the age of 15, as long as the court can prove that you exposed that child to an unreasonable risk of harm, or that you engaged in conduct that places such a child in imminent danger of death or harm, you may spend up to two years in jail and face a $10,000 fine.
  • For abandoning a child under circumstances that would cause a reasonable person to believe would place the child in imminent danger of death or harm, you may spend up to 20 years in prison, and have to pay a $10,000 fine.
  • If you are someone who had control or custody over a 15-year-old, intentionally abandoned that child in a place where that child is exposed to an unreasonable risk of harm, if the court can prove that you had no intention of returning for the child, you may spend up to 5 years in prison, and you may also have to pay a $10,000 fine.

Can I defend myself against a child endangerment charge?

There are several potential defenses to child endangerment charges, though they are largely dependent on the circumstances of your case. Oftentimes, we will argue that the act of endangerment was not willful, or that your actions do not qualify as criminal negligence. Sometimes, our firm can even state that the charge against you is completely false.
