How does Texas categorize assault charges?
The state of Texas breaks assault charges down into three primary categories, each reflecting the severity or violent nature of the crime committed. Of course, even a 3rd-degree felony assault charge can drastically affect your life for years to come, so you must retain the legal services of an experienced attorney who is ready to aggressively fight for your rights. The consequences of assault charges in Texas are as follows:
- 3rd Degree Felony: This is when someone commits a violent act against a person with which they either have a domestic relationship, an on-duty public servant, a person who contracts for family services within the government, an on-duty security officer, or a member of other emergency services while on the job. If convicted of a 3rd-degree felony charge, you may spend up to 10 years in prison and face a maximum fine of $10,000.
- 2nd Degree Felony: These assault charges are for when an individual commits a violent act against someone he or she has a domestic relationship with, or if the accused has been previously convicted of a similar crime. Additionally, if you choke or otherwise block another person’s airways with your hands, you will also most likely face a 2nd-degree felony. A charge of this magnitude results in up to 20 years in prison and a maximum fine of $10,000.
- 1st Degree Felony: First-degree felony assault is known as “aggravated assault” and occurs when someone assaults a person with which he/she has a domestic relationship with, a public official, emergency workers, security guards, informants, witnesses, or police officers. An aggravated assault must result in serious injury or involves the use of a weapon. A conviction can result in up to life in prison, as well as a significant fine.
