Here are some of the questions you may have.
What happened if I am charged with child endangerment or abandonment in Texas?
Some potential consequences of child endangerment/abandonment in Texas are as follows:
- If you have custody or control of a child younger than 15 years old and you intentionally abandon the child under circumstances that expose that child to an unreasonable risk of harm or engage in conduct that places a child younger than 15 years old in imminent danger of death or physical/mental harm, you may spend two years in jail and face a $10,000 fine.
- If you have custody or control of a child younger than 15 old and you intentionally abandon that child somewhere he/she is exposed to an unreasonable risk of harm and you had no intention of returning for the child, you may face up to five years in prison and a $10,000 fine.
- If you abandon a child under circumstances that a reasonable person would believe would place the child in imminent danger of death, or physical/mental harm, you may face up to 20 years in prison, as well as a $10,000 fine.
Are there any defenses against a child endangerment charge?
In many cases, our firm will argue that the act was not willful, or that there was no criminal negligence involved on your part. In other circumstances, we can even argue that the charge against you is purely false and made-up in an effort to get you in trouble for something you didn’t do. Of course, the defense we use relies on the specifics of your case, which is why you should speak with our experienced San Antonio criminal defense attorneys today so we can begin devising the best plan forward to help ensure you do not obtain a criminal record.
